Terms of Use

These Terms of Use (“Terms”) govern your access to and use of floattx.comand its content (the “Service”), operated by Sweetwater Promotions LLC, a Texas limited liability company (“FloatTX,” “we,” or “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service is informational only

FloatTX aggregates public river, lake, flow, flood, and boat-ramp data and presents general, informal tubing and recreation guidance. It is provided for general information only and is not professional, safety, legal, medical, or emergency advice. FloatTX is not the go/no-go authority for any water activity.

2. Assumption of risk, your safety is your responsibility

Tubing, swimming, boating, and other water activities are inherently dangerous and can result in serious injury or death. Conditions change rapidly; flows can swing dramatically with dam releases and flash floods; and low-head dams and other hazards can be deadly even at flows the Service describes as “good.” Flow ratings shown on FloatTX are informal community and outfitter guidance, not law or a guarantee of safety.

You are solely responsible for your own decisions and safety and for those in your care. Always verify current conditions with official sources, local authorities, and licensed outfitters before getting on the water, follow all posted rules and closures, wear appropriate safety equipment, and do not enter the water if you cannot swim. By using the Service, you knowingly and voluntarily assume all risks associated with your activities.

3. Accuracy and availability, no warranty

Data shown on FloatTX comes from third-party government and public sources (including USGS, TWDB, NWS/NWPS, and Comal County) and may be delayed, incomplete, inaccurate, or unavailable. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

4. Limitation of liability

To the maximum extent permitted by law, Sweetwater Promotions LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, personal injury, or death, arising out of or related to your use of, or inability to use, or reliance on, the Service or any data it presents, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the greatest extent permitted by law. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

5. Indemnification

You agree to indemnify and hold harmless Sweetwater Promotions LLC from any claims, damages, losses, or expenses arising out of your use of the Service or your violation of these Terms.

6. Acceptable use

Do not misuse the Service, for example, by attempting to disrupt it, scrape it at a volume that burdens it or the underlying data providers, circumvent security, or use it for any unlawful purpose.

7. Intellectual property

The FloatTX name, logo, design, original text, and the arrangement of the Service are owned by Sweetwater Promotions LLC and may not be copied or reused without permission. Underlying government data remains the property of its respective sources and is subject to their terms.

8. Third-party links and data

The Service links to and relies on third-party sources. We do not control and are not responsible for their content, accuracy, availability, or policies.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Texas.

10. Changes and severability

We may update these Terms from time to time; the “Last updated” date above reflects the current version, and continued use means you accept the changes. If any provision is found unenforceable, the remaining provisions stay in effect.
